As a visitor to the website and web application made available by CliqPic, Inc. ("CliqPic") or its affiliates (individually and collectively, the "Site"), you can engage in many activities without providing any Personal Information. The Site is intended for use in the United States.

However, when you register to use the Site, license content, or order products or services as a CliqPic subscriber, we may collect the following Personal Information from you:

• Contact information such as your name, phone number, and email address; and
• Profile data, including your username and password, profile photo, and details about your activity on the Site, such as search terms, plan purchases, and the Content that you license.

CliqPic does not directly collect or store your full payment card details. Purchases, subscriptions, and billing are processed through our payment processor, Stripe. When you make a purchase, your payment information is collected and processed directly by Stripe in accordance with Stripe's own privacy policy. CliqPic retains your name and email address tied to the order for receipts and order history.

If you submit content to CliqPic for licensing as a contributor, you may be asked to provide the following information:

• Contact information such as your name, phone number, zip code, and email address.
• Contributor information including your date of birth, desired display name, organization name, website (optional), profile information, and profile photo.
• Content and associated technical information you submit, including dimensions, file size, file format, creation date (if available), upload date, device type, frames per second, aspect ratio, and other non-location technical metadata included in the file.

To pay out contributor earnings, CliqPic uses Stripe Connect for creator payouts and Stripe Identity for identity verification. Bank account details, identity verification information, and tax information required for creator payouts or tax reporting are collected and processed directly by Stripe. CliqPic does not directly collect or store full bank account details or full tax identification numbers on its own systems. Stripe handles applicable Form 1099 reporting.

Depending upon the activity, some of the information that we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

As is true of most websites, the Site automatically collects certain technical and usage information as you browse, such as browser type, operating system, IP address, pages viewed, and interactions with the Site. We and our analytics providers use this information to understand how the Site is used and to improve our services. See the Cookie and Tracking Technologies section below for more detail.

You may request information about and access to Personal Information that we process by contacting us at hello@cliqpic.com. We may need to verify your identity before completing a request.

You may update your profile photo, name, email address, and password through your profile. You may manage your earnings, payouts, and subscriptions through Stripe, as applicable. To request deletion of your account, please use the Delete My Account form at cliqpic.com/delete-my-account. For other access, correction, deletion, or privacy requests, please contact us at hello@cliqpic.com. We may retain certain information as necessary to administer or enforce licenses, comply with legal obligations, resolve disputes, prevent fraud, or enforce our agreements. We will respond to your request within a reasonable timeframe.

CliqPic collects your information to provide services to you, comply with our legal obligations, and to improve our products and services. We do not sell, rent or share your personally identifiable information to or with third parties in any way other than as disclosed in this Privacy Policy. CliqPic may use this information to:

• Authenticate and provide access to the CliqPic Site and services.
• Process purchases, subscriptions, creator payouts, and identity verification through Stripe.
• Send you order / renewal confirmations.
• Register your rights, if any, to technical support or other benefits that may be made available to registered users.
• Respond to customer service requests, questions, and concerns.
• Administer your account.
• Host, organize, display, and make Content available to registered users for browsing and licensing, and administer Content licenses and creator accounts.
• Analyze uploaded Content using automated image-analysis tools to generate descriptive labels and search tags and to screen Content for adult or violent material.
• Send you requested product or service information.
• Keep you informed about special offers and services of CliqPic, subject to your communications choices below.
• Investigate, prevent or take action regarding illegal activities and/or violations of our Terms of Service.
• Meet our research and product/service development needs and to improve our Site, services and offerings; and
• Customize your experience, including targeting our services, search results, and offerings to you.

In certain situations, CliqPic may disclose Personal Information to comply with applicable law or legal process, respond to lawful requests by public authorities, protect our rights or the safety of others, investigate fraud or security incidents, or respond to other matters of public importance.

CliqPic uses Stripe Payments/Billing for customer purchases and subscriptions, Stripe Connect for creator payouts, and Stripe Identity for identity verification. Payment, financial, identity, and tax information submitted through Stripe is collected and processed directly by Stripe in accordance with Stripe’s privacy policy. CliqPic does not itself collect or store full payment card or bank account numbers or full tax identification numbers on its own systems.

We may also share Personal Information with other companies that perform services on our behalf, such as website and application hosting, cloud storage, database, authentication, content delivery, image processing, analytics, email and SMS communications, security, and other technical or operational service providers (see the Cookie and Tracking Technologies section below). Uploaded Content may be processed by image-analysis service providers to generate descriptive labels and search tags and to screen Content for adult or violent material. We only share the Personal Information necessary for them to perform those services, and we require any company with which we share Personal Information to protect that data in a manner consistent with this policy and to limit its use to the performance of services for CliqPic.

CliqPic also makes creator display names, Content, and related asset information available to registered users so they can browse and license Content. This information is not otherwise visible to the general public, although registered customers may create public share links that make Content available to recipients of those links. When a customer licenses Content, the Content and related asset information are made available to that customer in accordance with the applicable license.

We do not sell or otherwise provide Personal Information to other companies for the marketing of their own products or services.

We will retain your information for as long as your account is active and as reasonably necessary to provide services, process transactions and creator payouts, administer and enforce licenses, comply with legal and tax obligations, resolve disputes, prevent fraud, and enforce our agreements. If you wish to delete your account or request deletion of Personal Information, please use the Delete My Account form at cliqpic.com/delete-my-account or contact us at hello@cliqpic.com. We may retain information as necessary for the purposes described above.

Because licenses to Content may continue after Content is removed from active sale or a creator account is deleted, CliqPic may retain Content, metadata, license history, and related records as necessary to administer or enforce those licenses. Content that has already been licensed may remain in the applicable customer's asset library and in copies the customer has downloaded even if the creator later removes the Content or closes the account.

CliqPic does not sell your personal data or personal information to any third party. CliqPic does not use cookies, trackers, or advertising networks for interest-based advertising or cross-site tracking, and does not run third-party ads on the Site.

CliqPic will use your Personal Information for the purposes described in this Privacy Policy and as otherwise permitted by applicable law. If we materially change how we use Personal Information, we will provide notice as described below and obtain consent where required by applicable law.

You may opt out of receiving CliqPic’s marketing emails by clicking the "unsubscribe" link included in those emails. You may opt out of SMS messages by replying "STOP" to any SMS messages you receive from us. You can also reach us directly at hello@cliqpic.com. CliqPic may still send you service-related communications, including registration emails, account or security notices, notices about changes to applicable terms or policies, communications triggered by actions you take on the Site, and billing, payment, payout, license, or other transaction notices. If you no longer wish to receive service-related communications, you may request deletion of your account using the Delete My Account form, subject to any information we need to retain as described above.

The Personal Information that you provide in connection with the use of the Site is protected in several ways:

• Access by you to your account profile is available through a password and unique customer ID selected by you. This password is encrypted. You should use a strong, alpha-numeric password and not divulge it to anyone.
• Your Personal Information resides on secure servers that only selected CliqPic personnel and contractors have access to via password.
• Your Personal Information is encrypted whenever it is transmitted to CliqPic.
• When you enter sensitive information (such as credit card number) on our registration or order forms, we encrypt that information using transport layer security technology.

We strive to protect the Personal Information submitted to us, both during transmission and once we receive it. The Site uses a limited number of cookies and other technologies to operate and to help us understand how the Site is used:

• Login/session cookies: These are strictly necessary cookies that keep you securely logged in to your account. Without them, the Site's core functionality will not work properly.
• Google Analytics cookies: We use Google Analytics to understand aggregate trends in how visitors use the Site, such as pages viewed and interactions with the Site. Google Analytics uses cookies and may collect information such as browser and device information, IP address, approximate location, and interactions with the Site. You can learn more about how Google uses this data in Google’s Privacy Policy, and you can opt out of Google Analytics tracking across websites by installing the Google Analytics Opt-out Browser Add-on.
• Vercel Web Analytics: We also use Vercel Web Analytics on the web application to understand aggregate trends in how visitors use the application. Vercel Web Analytics is cookieless and does not use cross-site identifiers or advertising networks.

CliqPic does not use cookies for advertising or cross-site tracking, and does not run any third-party ads on the Site. Because CliqPic does not engage in cross-site behavioral advertising, the Site does not currently respond to browser "Do Not Track" signals. We do not authorize third parties to collect Personal Information about your online activities over time and across unrelated third-party websites for targeted advertising while you use the Site. Most web browsers allow you to block or delete cookies through your browser settings; please note that blocking the login cookie may prevent you from staying logged in or using certain features of the Site.

CliqPic may amend this Privacy Policy from time to time and will provide notice by email or on the home page of the Site when we make material changes prior to the change becoming effective. We will also update the effective date at the top of this Privacy Policy.

If a material change would use Personal Information for a materially different purpose that requires consent under applicable law, we will obtain that consent. If CliqPic is acquired by or merged with another entity, Personal Information may be transferred in connection with the transaction, subject to applicable law.

CliqPic will not discriminate against you for exercising privacy rights available to you under applicable law, except as permitted by law.

Our Site includes links to other Web sites whose privacy practices may differ from those of CliqPic. If you submit personal information to any of those sites, your information may be governed by their privacy policies. We encourage you to carefully read the privacy policy of any Web site you visit.

The Site is not intended for anyone under the age of 18, and CliqPic does not knowingly collect Personal Information from anyone under the age of 18. If you are under 18, do not enter information on this Site or engage our services. If you believe someone under the age of 18 has provided Personal Information to CliqPic, please contact us at hello@cliqpic.com so that we can investigate and, where appropriate, delete the information and terminate the account.
